Customer Terms

Version 2026-11-02 · Effective [EFFECTIVE DATE]

These Customer Terms apply when you submit a service request, sign a proposal, or make a payment through this website. The website is run by the service business you hired (the “Business”) using software provided by [AGILITIES LEGAL NAME] d/b/a HitchPoint (“HitchPoint”, “we”). HitchPoint also processes online payments on behalf of the Business. Many independent businesses use the same software, so these terms are written generally. Please read them before you sign or pay.

1. Who you are dealing with

  1. Your agreement for the work is with the Business, not with HitchPoint. The Business is responsible for its services, prices, scheduling, workmanship, warranties, and customer service.
  2. HitchPoint provides the website, request form, proposal, e-signature, and payment software the Business uses, and processes online payments on the Business’s behalf. HitchPoint does not perform repairs or other services and is not a party to your agreement with the Business for the work.
  3. Questions about your job, price, or refund should go to the Business using the contact details on its website or proposal.

2. Submitting a request

When you submit a request you may provide your name, phone number, location (including GPS coordinates if you choose to share them), vehicle or equipment details, a description of the problem, and a photo. Please give accurate information, and only upload photos you have the right to share. Submitting a request does not guarantee the Business will accept the job or arrive at a particular time.

3. Consent to be contacted about your request

By submitting a request, you agree that the Business (and its software provider on its behalf) may call you and send text messages to the phone number you provide about your request, including to confirm details, send your quote or proposal, share arrival updates, and send payment links and receipts. These messages may be sent using automated technology. This is not consent to marketing messages, and agreeing is not a condition of purchasing anything. Message and data rates may apply. Reply STOP to stop texts.

4. Proposals and electronic signatures

  1. The Business may send you a proposal describing the work and price. Read it carefully. When you sign, you are agreeing to the proposal’s terms with the Business.
  2. Consent to electronic records and signatures. You agree to use electronic records and signatures under the federal Electronic Signatures in Global and National Commerce Act (ESIGN Act) and the Uniform Electronic Transactions Act (UETA) as adopted in your state. Your typed name and finger-drawn signature have the same legal effect as a handwritten signature on paper.
  3. What is recorded. When you sign, the system records your typed name, your signature image, the date and time, your IP address, and your device and browser information (user agent). This record is kept as proof of the agreement and may be used if there is a dispute.
  4. Your rights. You may ask the Business for a paper copy of the signed proposal at no charge. You may decline to sign electronically and instead ask the Business for a paper process. You can withdraw consent to electronic records for future documents by telling the Business; this does not affect documents already signed. To view and keep electronic records you need a device with a current web browser and the ability to save or print a web page.

5. Payments

  1. Online card and bank (ACH) payments are processed by HitchPoint on behalf of the Business, using Stripe. The charge will appear on your card or bank statement as “HITCHPOINT” plus a short form of the Business’s name.
  2. No extra fee for paying online. You pay only the amount on the Business’s invoice, proposal, or deposit request. HitchPoint does not add a processing fee or surcharge to your total.
  3. Card and bank details are entered into Stripe’s secure system and are not stored by the Business or HitchPoint.
  4. Any deposit (for example a diagnosis deposit) and how it is credited toward the job are described by the Business in its proposal or payment page.

6. Refunds, cancellations, and disputes

Refunds and cancellations are decided by the Business under its own policy and any applicable law. Please contact the Business first if there is a problem with your job, a refund, or a charge. When the Business approves a refund of an online payment, HitchPoint sends it back to your original payment method. For questions about payment processing, you may also contact HitchPoint at [SUPPORT EMAIL]. You may also have rights with your card issuer or bank. If you file a chargeback or dispute, HitchPoint and the Business may share your signed proposal, photos, job notes, and payment records with Stripe and your bank to respond.

7. Your information

The Business controls the request and job information you provide, and HitchPoint handles it on the Business’s behalf. HitchPoint and Stripe also receive your payment information to process online payments. Your photos and signature are visible only to the Business’s logged-in users and to HitchPoint platform administrators for support. Your information is not sold. See the Privacy Policy for details, including the service providers involved (such as Stripe for payments and Twilio for text messages).

8. Acceptable use

Do not submit false or fraudulent requests, use someone else’s payment method without permission, upload unlawful or offensive content, or try to interfere with the website.

9. Software provider disclaimer

The website and payment software are provided by HitchPoint “as is.” To the fullest extent the law allows, HitchPoint is not responsible for the Business’s services, delays, workmanship, or pricing, and HitchPoint’s liability to you for any claim related to the software or payment processing is limited to the amount of the payment involved in the claim. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived.

10. Governing law

Your agreement with the Business for the work is governed by the law that applies to that agreement. Matters about the software, payment processing, and these Customer Terms, as they relate to HitchPoint, are governed by the laws of the State of [STATE], except where your local consumer law says otherwise.

11. Changes

These Customer Terms may be updated. The version shown when you sign or pay applies to that signature or payment.
